What happens if someone gets hurt on my halfpipe in new jersey? if they are an invited guest? uninvited?
I’ll assume you mean on private property?
It’s actually fairly tricky, but here are a few factors..
1> If they had permission – if someone was using it without permission (and the area was properly secured) you may not be liable for injuries.
2> Equipment maintenance – was the half-pipe constructed sturdily? Well maintained? Did any problems contribute to the injury?
3> Nature of activity – were helmets and other safety equipment worn? (This can work both ways). This relates to the concept of implied risk, if you knowingly undertake a dangerous activity you are assumed to bear some of the risk.
If based on the items above you are found to be at fault, then a claim would be filed against your insurance. Some insurances do not cover items such as half pipes, in which case the owner of the property would be liable for medical costs and puntitive damages,
Invited or not you are going to pay a butt-load of money. You will be sued until your wallet bleeds. Invited or not you have an accident injury lawyer’s pipe dream in your yard. You will make many people very, very rich.
